Asset Prevention Measures and Confiscations

Prevention measures are administrative measures that significantly affect the fundamental freedoms of the individual. They may be adopted against persons deemed socially dangerous, regardless of the existence of criminal proceedings or a conviction. For this reason, they are defined as ante delictum (or praeter delictum) measures.

The firm has gained great experience in delicate proceedings concerning the application of asset prevention measures provided for by the so-called Anti-Mafia Code (Legislative Decree no. 159/2011): seizure and confiscation; security deposits and real guarantees; judicial administration of personal assets or assets connected to economic activities and companies; judicial control. It has also developed specific knowledge of legal issues concerning the so-called anti-mafia interdiction, a measure issued where there is a risk of infiltration, which entails particularly prejudicial consequences for the companies concerned, whose activity is, in some cases, completely paralysed.
